Advances in technology, and the digital revolution, will transform the abilities of others to capitalize upon and exploit the creative work of actors, authors, athletes, musicians, and others, celebrities and individuals alike, whose image, likeness or performance is of commercial value.
Currently, there exists a patchwork of state laws that vary greatly in their protection of your work and identity. The American Bar Association will soon propose Federal legislation on this issue that will severely limit the minimal protections already in place under State laws. What the legislation looks like and how effective it is in protecting your fundamental, Constitutionally guaranteed rights is another matter.
The Creative Property Rights Alliance (CPRA) has been created to see that the proposed Federal legislation affords you the most potent, effective, and meaningful protections to which you are entitled. CPRA exists to ensure that those who might profit from misusing your work do not succeed in shaping this important legislation.
Why should you care and how does this issue affect you now? The legislation presently under consideration could dramatically and negatively affect your image. Others could commercially exploit you without compensation to you and without your permission.
Could this issue impact my heirs? Yes. Federal legislation is needed to guarantee that your children and heirs will benefit from your work, rather than others.
Does this only apply after I am gone? Currently there are abuses in the use of your identity that can occur after your death as well, that only expensive litigation can redress. We must clarify what your rights are in a uniform way, subject to as little confusion and differing state interpretations as possible.
What's the urgency? We have become aware of Federal legislation that will be presented that will reduce protections currently offered by several states. Someone must be vigilant in keeping watch over your interests. That is what CPRA is all about.
Who will oppose our efforts? Studios, memorabilia companies, and other businesses who profit from the commercial exploitation of celebrities, and who would prefer to be able to do so without restrictions from you, the individual, or your heirs will be the beneficiaries of the presently planned ABA legislation.
